site after changes are posted constitutes your acceptance of this
agreement as modified.

and enjoyment of the site by any third party.

or relating to Cardiac Athletes are provided "as is" without

kind whether express or implied. In no event will Cardiac Athletes

from Cardiac Athletes. Nothing contained herein shall be construed
as conferring any licence by Cardiac Athletes to use any item displayed.
Documents on this site may be copied for personal, non-commercial
use only on the condition that copyright and source indications are
also copied, no modifications are made and the document is copied
entirely. However, some documents and photos have been published on
this site with the permission of the relevant copyright owners. All

Cardiac Athletes Merchandise Policy
It is our policy to have everyone wearing merchandise carrying the Cardiac Athletes logo sign a waiver before participating in Team Marathons, Relays and other sporting events. This waiver is identical to the ones used to gain entry into any race. It is recommended that anyone considering buying merchandise carrying the Cardiac Athletes logo for independent home use should also read the following waiver.

By indicating your acceptance, you understand, agree, warrant and covenant as follows:
I hereby, intending to be legally bound for myself, my heirs, executors and administrators, waive and release any and all rights for liability and damages I may have against any officer, agent, employee, or volunteer of H.E.A.R.T. and/or Cardiac Athletes and their representatives, successors, and assigns for any and all injuries or death suffered by me in or arising by my participation in Marathons, Relays or any of the other activities organised by H.E.A.R.T. and/or Cardiac Athletes and held in conjunction with Marathons and Relays. I acknowledge that it is my responsibility to understand the risks and precautions I should take. I attest that I am who I claim to be, am physically fit, and have sufficiently trained for this event.
Waiver: you understand that participation in the event is potentially hazardous, and that a registered party should not participate unless they are medically able and properly trained. you understand that events may be held over public roads and facilities open to the public during the event and upon which hazards are to be expected. participation carries with it certain inherent risks that cannot be eliminated completely ranging from minor injuries to catastrophic injuries including death. you understand and agree that in consideration of being permitted to participate in the event, you and any registered party, their heirs, personal representatives or assigns of you or the registered party do hereby release, waive, discharge and convenant not to sue any officer, agent, employee, or volunteer of h.e.a.r.t. and/or cardiac athletes for any and all liability from any and all claims arising from participation in the event by you or any registered party.
Severability: You further expressly agree that this Agreement and Waiver is intended to be as broad and inclusive as is permitted by law and that if any provision of this Agreement and Waiver shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and Waiver and shall not affect the validity and enforceability of any remaining provisions.
By indicating your acceptance of this agreement and waiver, you are affirming that you have read and understand this agreement and waiver and fully understand its terms. you understand that you are giving up substantial rights, including the right to sue. you acknowledge that you are signing the agreement and waiver freely and voluntarily, and intend by your acceptance to be a complete and unconditional release of all liability to the greatest extent allowed by law.
